O “CABO DE GUERRA” DA REGULAMENTAÇÃO DO NOVO FUNDEB

In 2020, the right to education was the subject of an important agenda in the Congress: the approval of “New Fundeb” (EC. 108/2020) and its regulamentation. This article aims to discuss, from the perspective of law and public policies, based on a descriptive analysis, the process of approval of the constitutional amendment to the Brazilian Constitution, comparing the processes of transition of the funds, as well as the analysis of the movement of politicians and those involved in the construction of the “New Fundeb” regulation text, demonstrating the government and parliamentary expedients of political movement in the legislative process, the expedients used both for the approval of Amendments to the Constitution, as well as for its regulation, in order to understand the role of political agents and the strategies used to realize the right to education.No ano de 2020, o direito à educação foi alvo de uma importante pauta no Congresso Nacional: a aprovação do Novo Fundeb (EC. 108/2020) e a sua regulamentação. Este artigo tem por objetivo discutir, a partir da abordagem de direito e políticas públicas, calcado em uma análise descritiva, o processo de aprovação da emenda constitucional, comparando os processos de transição dos fundos. Far-se-á a análise da movimentação dos atores políticos e interesses envolvidos na construção do texto de regulamentação do Novo Fundeb demonstrando os expedientes governamentais e parlamentares de movimentação política no processo legislativo, utilizados tanto para aprovação de Emendas á Constituição quanto para a sua regulamentação, de modo a compreender o papel dos agentes políticos e as estratégias utilizadas para concretização do direito à educação
